RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS, AND INDEMNITY AGREEMENT

Released Parties

Strait Up Climbing Ltd. (the “Company”), including its owners, officers, directors, partners, shareholders, agents, instructors, independent contractors, affiliates, volunteers, employees, representatives, successors, and assigns, and all other persons or entities acting on its behalf (collectively, the “Released Parties”).

Definition

In this agreement, the term “Climbing Activities” includes all activities, events, or services provided, arranged, organized, conducted, sponsored, or authorized by the Company.
Without limitation, this includes: indoor and outdoor climbing and bouldering, rappelling, belaying, training, stretching, yoga, pilates, observing others, competitions, volunteering, instructional sessions, transportation to climbing sites, and all other related activities.

Assumption of Risks

I understand that participation in Climbing Activities involves risks, dangers, and hazards, including but not limited to:

• Slips, trips, and falls; cuts and abrasions
• Equipment failure (ropes, harnesses, anchors, climbing holds, belay devices, or other climbing gear)
• Falling or being fallen on by other participants
• Negligence of instructors, staff, or other climbers
• Environmental risks such as falling rocks, uneven terrain, weather, wild animals, insect bites, and hazardous plants
• Infectious diseases, including viruses, bacteria, parasites, and fungi, which may be transmitted through direct or indirect contact
• Serious injury, permanent disability, or death

I freely accept and fully assume all such risks, dangers, and hazards, and the possibility of personal injury, death, property damage, or loss resulting therefrom.

Release of Liability, Waiver of Claims, and Indemnity

In consideration of the Company allowing me (or the minor for whom I am signing) to participate in Climbing Activities, I agree to the following:

1. To waive any and all claims I may have against the Released Parties, and to release the Released Parties from any and all liability for injury, death, loss, damage, or expense arising from participation in Climbing Activities, including claims resulting from:
• Negligence,
• Breach of contract, or
• Breach of any statutory or other duty of care, including duties under the Occupiers Liability Act (British Columbia).
2. To hold harmless and indemnify the Released Parties from any liability for damage to property or injury to any third party resulting from my participation.
3. This agreement shall be binding upon my heirs, next of kin, executors, administrators, representatives, and assigns.
4. This agreement shall be governed by the laws of the Province of British Columbia, and any legal action shall be brought exclusively in the courts of British Columbia.

Additional Terms

• I acknowledge that drugs and alcohol impair judgment and that I will not participate while under their influence.
• I understand the Company is not responsible for lost or stolen personal property.
• I grant permission for photos or videos taken during Climbing Activities to be used for the promotion of Strait Up Climbing Ltd.

If the participant is under 19 years of age, this section applies.

I, , confirm that I am the parent or legal guardian of the participant named below.
By signing below, I:

• Consent to the minor’s participation in Climbing Activities;
• Have explained the terms of this agreement and the risks to the minor;
• Confirm, to the best of my knowledge, the minor is physically fit to participate; and
• Acknowledge that while I provide this consent and indemnity, British Columbia law may limit a parent/guardian’s ability to waive certain rights of a minor.
